Journal of Human Values, Volume 28, Issue 1, Page 29-43, January 2022. The COVID-19 crisis has revealed a need for rethinking approaches to education and livelihoods. Education in its present dispensation does not provide equitable access to children from marginalized segments of the population. It also suffers from deficits in the areas of social and emotional skills, over-emphasis on the three Rs, language used as a medium of instruction, and excessive competition for scoring marks, among others. There is very low (...) uptake of vocational education. The National Education Policy 2020 tries to address some of these issues and plans on closer integration of vocational education with the school framework. High unemployment rates of educated youth, along with underemployment due to skill mismatch, show poor school-to-work transition and underscore the importance of TVET for youth in the future. Skill already exists in the economy in informal knowledge systems which are largely undocumented and thus not acknowledged in the formal system. These need to be combined with Western-centric knowledge systems so that the imbalance between formally educated/trained workers and informally trained workers is redressed. There is also a need to bring back the joy of learning, as Tagore’s experimentation with education has demonstrated. (shrink)

Be- cause the research (...) involves the use of human embryos, it triggers serious debate on ethical issues. Opponents consider the embryo to be an early form of human life that should be respected and not destroyed. However, the majority of scientists support embryonic stem cell research, believing that it offers good prospects for the treatment of diseases that have remained incurable until now and so will benefit humankind. The Ethics Committee of the Department of Ethical, Legal, and Social Implications of the Chinese National Human Genome Center at Shanghai seriously discussed the ethical debate initiated by embryonic stem cell research. We concluded that we should support the scientists of our country in actively carrying out human embryonic stem cell research for the noble cause of "medicine being a beneficent art." For the healthy and orderly development of human embryonic stem cell research in our country, we put forward the following recommended Ethical Guidelines for Human Embryonic Stem Cell Research as a reference for leaders, administrative departments, and related scientists. If scientists can discover the mechanism of differentiation of human embryonic stem cells, it will be possible to induce differentiation of human embryonic stem cells to form various types of human cells for clinical cell therapy. If human embryonic stem cell research can be integrated with modern biomedical engineering techniques, it also will be possible to make repair and replacement of human tissues and organs a reality. Article 2. There are two ways to classify human embryonic stem cells. One way is to classify them according to their potential for differentiation. There could be three kinds of stem cells: totipotent stem cells, pluripotent stem cells, and unipotent stem cells.A totipotent stem cell has the potential to develop into a whole individual. It can differentiate into the more than 200 cell types in the whole body, construct any tissue or organ of the body, and finally develop into a whole individual. The fertilized egg and the cleavage cells at the very early stage of embryonic development are totipotent stem cells.A pluripotent stem cell has the potential to differentiate into many cell types derived from the three embryonic layers. Over the past 3 years, the authors have pursued unique cross-college collaboration. They have hosted a National Endowment for the Humanities (NEH)–funded Humanities Gaming Institute and team-taught a cross-listed course that brought together students from the humanities and computer science. Currently, they are overseeing the development of an NEH-supported social history game called Desperate Fishwives. In the process, the authors have realized that “game” is not the most appropriate designator for the kind of projects they (...) are pursuing. Instead, they propose critical interactives, a term that suggests projects that mobilize ludic methods in order to engage participants in socially and politically sensitive, indeed controversial, subject matter. Their most recent project, Ghosts of the Horseshoe, offers an initial look at how critical interactives are particularly apt at raising awareness about the relations among institutional policy, broader public policy, and the ways that people negotiate the public history of a particular place. The Lilly Endowment Research Program in Christianity and Politics is an enviable form of energetic subsidy which implements an American concern for intellectual integrity much more realistically than the lipservice which older and more complacent nations commonly profess. It believes that Christian culture should be brought to bear in detail upon the actual problems of politics and social order and it devotes an annual series of public lectures to this high-minded aim. The published series is inaugurated in this exploratory (...) essay into the possible nature of Christian philosophy itself by a distinguished Harvard professor, the text being developed from his Walter Freeman Whitman Lectures and Lilly Foundation Lectures of 1958. Holding that our anxious century has lost confidence in the self-sufficiency of human reason to establish an evident and closed order in reality, he believes that men are now ready to contemplate the reality of a chastened reason open to the influence of religious ideals. And he claims that the very reception of the term, ‘Christian philosophy’ only recently into common usage is ‘the expression of a noteworthy gap in our intellectual history’. (shrink)

The eminent 20th-century Polish philosopher Tadeusz Kotarbiński (1886–1981) is the author of a novatory philosophy of combating global suffering. Kotarbiński’s theory states that although humans are by nature rational, and additionally endowed with goodwill, human life nonetheless offers an endless stream of pain and suffering. Some of this suffering results from the essence of the human condition and can not be helped, mostly, however, it is the effect of the meanderings of the human mind and can be eliminated by education. (...) More than by anything else, the human mind is brought to err by so-called phantasmats, or emotion-laden intellectual mirages, mainly of a religious, national and political nature. Such phantasmats are the source and fundament of humanity’s divisions into hostile cultures, nations and political systems, which in turn gives rise to conflict between civilizations, countries and ideologies, inadvertently accompaniedby mounting mistrust, suspiciousness, xenophobia, hatred, armaments—and ultimately war. All this means an ocean of suffering for countless individuals. Both in philosophy and praxis Kotarbiński strove to eliminate all sources of suffering, including that stemming from differences in culture, development, nationality, and politics. He believed in the motivating powers of reason and the creative powers of persuasion, and consequently sought to attain his goal by rationalization, or focusing solely on the logic-driven and common experiencing of the human fate in a bid to eradicate cultural, national and political difference. Thus united, humanity would melt into one big human state devoted to lingering inevitable suffering. In this paper I challenge the usual interpretations of Newton's and Leibniz's views on the nature of space and the relativity of motion. Newton's ‘relative space’ is not a reference frame; and Leibniz did not regard space as defined with respect to actual enduring bodies. Newton did not subscribe to the relativity of intertial motions; whereas Leibniz believed no body to be at rest, and Newton's absolute motion to be a useful fiction. A more accurate rendering of the opposition between (...) them, I argue, leads to a wholly different understanding of Leibniz's theory of space, one which is not susceptible to the objections Newton had raised against Descartes regarding the representation of motion. As climate change in West Africa poses profound limitations on rainfed agriculture, policymakers and practitioners may again turn to irrigated agriculture to provide food for a growing population. Gendered analyses of irrigation projects reveal that in many cases women’s participation in irrigated agriculture has been limited due to a lack of access to land and water. Past research in the Upper Valley of the Senegal River suggests that variables other than access to land and water condition women’s participation in irrigated (...) agriculture. Fully understanding women’s participation in irrigated agriculture demands examination of intra-household dynamics and livelihood strategies as well as the impacts of agricultural commodification. Black Nationalism and the Issue of SeparationThe first question we have to raise when discussing the thought of Malcolm X is "Which Malcolm X are we discussing?" Malcolm X, who was a member of the Nation of Islam (1952–1964) and served as its speaker, is not the same Malcolm who left the organization and founded Muslim Mosque, Inc. (...) (1964), and both are different from the Malcolm who embraced Sunni Islam (from 1964 until his assassination in 1965). In each of these periods, Malcolm held a different perception of the desired future of members of black communities in the United States. Despite that, Malcolm X remained faithful to the idea of black nationality throughout his active years—even if the contents of this idea changed along the years. In this paper, I show that the developments that took place within Malcolm's positions, and specifically the changes on the issue of emigration, do not affect his support for black nationalism.I do not begin this discussion with an attempt to define black nationalism, as there is no one clearly and timelessly defined black nationalism. The perception of black nationalism that took center stage in the nineteenth century is fundamentally different from that of the twentieth century. In fact, as we will soon see, even in the nineteenth century, one can find conceptual plurality of black nationalisms, and the same is true for the twentieth century.Malcom's activism begins in the days of abundant civil and governmental support for the practice of racial segregation. Facing it is the Nation of Islam organization, of which Malcolm is a member in the first phase of his activism, calling for—in a sort of amplified mirror-image, redesigned so as to remove the sting of white nationalism—a complete territorial separation between whites and blacks, for the benefit of the black community, of course. The [End Page 23] organization links this call to what is termed "the racial problem" and argues that territorial separation is the only solution to the problem (Essien-Udom 259).When discussing separation, rather than emigration, in the context of the Nation of Islam, the emphasis is on Elijah Muhammad's (hereafter: E. Muhammad) demand for the US government to allocate a dedicated territory for the founding of the physical black nation.1 Along with land—and here we encounter a motif that is repeated in Malcolm X's speeches—is the demand for material aid for some time, so the black nation can find its footing (Essien-Udom 260). In fact, it is a call for independence on a territory allocated for that purpose, but part of the territory of the United States. Later, at the beginning of Malcolm's second phase of activism, after leaving the Nation of Islam, he said the following in a radio interview with A. B. Spellman:Spellman:What is the program for achieving your goals of separation?Malcolm:A better word to use than separation is independence. This word separation is misused. The thirteen colonies separated from England but they called it the Declaration of Independence; they don't call it the Declaration of Separation, they call it the Declaration of Independence. When you're independent of someone you can separate from them. If you can't separate from them, it means you're not independent of them.(Malcolm X, "Independence, Not Separation" 71–72)Whereas separation is a negative move—I break away from something—independence is a positive one: I become my own sovereign. In order to illustrate this, Malcolm argues, "[w]hen you're independent of someone, you can separate from them"—that is, that independence is a sufficient condition for separation. To this, he adds: "If you can't separate from them, it means you're not independent of them." That is, Malcolm emphasizes that separation is a necessary condition for independence. On the other hand, however, Malcolm's phrasing implies that separation is not enough for independence. Independence includes another process that separation lacks. Interdisciplinary research has been a popular idea with many people in the last 20 years. Academic administrators have admonished their faculty to become more interdisciplinary. Students often request the chance to pursue an interdisciplinary degree. While the issue of managing interdisciplinary projects has received a fair amount of attention by those interested in science management, interdisciplinary research has received little attention from historians, philosophers or sociologists of science or from scientists themselves. Yet, there l;lre a number of cases within the (...) life sciences where researchers have been actively engaged in endeavors that take them across disciplinary boundaries. These are ripe for investigation by those interested in the process of science. To provide an in-depth study of some historical or contemporary cases of cross disciplinary research activity in the life sciences, a conference was held at Georgia State University in May, 1984. This conference was supported by the National Endowment for the Humanities (U. S. A. ) through their research conference program. Over a three-day period historians, philosophers, and researchers who were actively engaged in various of the life sciences discussed specific examples of interdisciplinary research and tried to analyze what was needed for successful crossing of disciplinary boundaries. After the conference, each of the participants revised their original presentations, partly in light of the discussion at the conference. The papers in this volume are the fruits of that endeavor. The “dragon” that graces the cover of this volume has a story that goes with it. In the summer of 1980, I was on the teaching staff of the Summer Institute on Medieval Philosophy held at Cornell University under the direction of Norman Kretzmann and the auspices of the Council for Philosophical Studies and the National Endowment for the Humanities. While I was giving a series of lectures there (lectures that contribute to this volume, as it turns (...) out), I went to my office one morning, and there under the door some anonymous wag from the Institute had slid the pen and ink drawing you see in the picture. It represents “Supposition” as a dragon, making a rude face at the viewer. The tail of the dragon is divided — not entirely accurately, as it turns out — into the various branches and subbranches of supposition. If the details are not altogether correct, the spirit is certainly understandable. (shrink)

This book derives from a 1993 National Endowment for the Humanities Summer Institute on Knowledge, Teaching, and Wisdom. The Institute took place at the University of California, Berkeley, and was co-directed by Keith Lehrer and Nicholas D. Smith. The aims of the Institute were several: we sought to reintroduce wisdom as a topic of discussion among contemporary philosophers, to undertake an historical investigation of how and when and why it was that wisdom faded from philosophical view, and (...) to ask how contemporary epistemological theories might apply to the obviously related subjects of teaching and wisdom. In recruiting participants, Lehrer and Smith put the greatest emphasis on those with professional interests in epistemology and the history of philosophy, of the ancient Greeks especially ancient Greek philosophy (because in the writings all three subjects of the Institute were explicitly related and discussed). But in addition to these two groups, some effort was made also to include others, with academic specializations in a variety of fields other than epistemology and the history of philosophy, to ensure that a broad perspective could be achieved in our discussions. To an obvious extent, the papers in this book reflect the recruitment emphases and variety. They also testify to the extent that the Institute managed to bring life to our subjects, and to raise very old questions in a contemporary context. (shrink)

This paper examines the legal and ethical problems involved in reconciling two separate rights, each of which plays a fundamental role in the current philosophical debate surrounding international relations and international law: the right to national sovereignty to which many states lay claim, on the one hand , and the right to self-determination , on the other.Refusal to grant the right of self-determination frequently leads to the violation of the human rights of nationally, ethnically, racially or religiously defined population (...) groups. In any justification of or claim to national sovereignty, and also in the claim of national minorities to autonomy, the concept of nationhood plays a decisive role. In part I of this paper, I will therefore be attempting to shed light on the history and the terminological content of the concept of nationhood, with a view to making use, in part II, of the knowledge thus gained in the search for a solution to the outlined legal and ethical problem. In this debate, I distinguish between the nation and the nation-state. It is possible to conceive nations which have no state, as well as states which serve no nation or serve several nations at once as a political forum.In resolving the question of whether nation-state sovereignty takes priority over regional autonomy or vice versa, we will also be addressing the question of the importance attributable to human rights, taken to mean individual rights, as against the collective rights of both nation-state sovereignty and regional autonomy. H´ector-Neri Casta˜neda-Calder´on (December 13, 1924–September 7, 1991) was born in San Vicente Zacapa, Guatemala. He attended the Normal School for Boys in Guatemala City, later called the Military Normal School for Boys, from which he was expelled for refusing to fight a bully; the dramatic story, worthy of being filmed, is told in the “De Re” section of his autobiography, “Self-Profile” (1986). He then attended a normal school in Costa Rica, followed by studies in philosophy at the University of San (...) Carlos, Guatemala. He won a scholarship to the University of Minnesota, where he received his B.A. (1950), M.A. (1952), and Ph.D. (1954), all in philosophy. His dissertation, “The Logical Structure of Moral Reasoning”, was written under the direction of Wilfrid Sellars. He returned to teach in Guatemala, and then received a scholarship to study at Oxford University (1955–1956), after which he took a sabbatical-replacement position in philosophy at Duke University (1956). His first full-time academic appointment was at Wayne State University (1957– 1969), where he founded the philosophy journal Noˆus (1967, a counter-offer made to him by Wayne State to encourage him to stay there rather than to take the chairmanship of philosophy at the University of Pennsylvania). In 1969, he moved (along with several of his Wayne colleagues) to Indiana University, where he eventually became the Mahlon Powell Professor of Philosophy and, later, its first Dean of Latino Affairs (1978–1981). He remained at Indiana until his death. He was also a visiting professor of philosophy at the University of Texas at Austin (1962–1963) and a fellow at the Center for Advanced Study in the Behavioral Sciences (1981–1982). He received grants and fellowships from the Guggenheim Foundation (1967–1968), the T. Andrew Mellon Foundation, the National Endowment for the Humanities, and the National Science Foundation. He was elected President of the American Philosophical Association Central Division (1979– 1980), named to the American Academy of Arts and Sciences (1990), and received the Presidential Medal of Honor from the Government of Guatemala (1991). Casta˜neda’s philosophical interests spanned virtually the entire spectrum of philosophy, and his theories form a highly interconnected whole.. (shrink)

Postmodernism once more—that breach has begun to yawn! I return to it by way of pluralism, which itself has become the irritable condition of postmodern discourse, consuming many pages of both critical and uncritical inquiry. Why? Why pluralism now? This question recalls another that Kant raised two centuries ago—“Was heist Aufklärung?”—meaning, “Who are we now?” The answer was a signal meditation on historical presence, as Michel Foucault saw.1 But to meditate on that topic today—and this is my central claim—is really (...) to inquire ‘Was heist Postmodernismus?”Pluralism in our time finds itself in the social, aesthetic, and intellectual assumptions of postmodernism—finds its ordeal, its rightness, there. I submit, further, that the critical intentions of diverse American pluralists—M. H. Abrams, Wayne Booth, Kenneth Burke, Matei Calinescu, R. S. Crane, Nelson Goodman, Richard McKeon, Stephen Pepper, not to mention countless other artists and thinkers of our moment—engage that overweening query, “What is postmodernism?,” engage and even answer it tacitly. In short, like a latter-day M. Jourdain, they have been speaking postmodernism all their lives without knowing it.But what is postmodernism? I can propose no rigorous definition of it, any more than I could define modernism itself. For the term has become a current signal of tendencies in theater, dance, music, art, and architecture; in literature and criticism; in philosophy, psychoanalysis, and historiography; in cybernetic technologies and even in the sciences. Indeed, postmodernism has now received the bureaucratic accolade of the National Endowment for the Humanities, in the form of a Summer Seminar for College Teachers; beyond that, it has penetrated the abstractions of “late” Marxist critics who, only a decade ago, dismissed postmodernism as another instance of the dreck, fads, and folderol of a consumer society. The ethics of citation has attracted increased attention in recent discussions of research and publication ethics, fraud and plagiarism. Little attempt has been made, however, to situate specific citation misbehaviors in terms of broader ethical practices and principles. To investigate researchers’ perceptions of citation norms, we surveyed active US researchers receiving federal funding from the National Institutes of Health (NIH), the National Science Foundation (NSF), and the National Endowment for the Humanities (NEH). Participants (n = (...) 257) were asked about citation norms they endorse (norm reports), the behaviors they perceive others to engage in (peer reports), and their own citation behaviors (self-reports). Our analyses showed that while considerable discrepancies exist between norm reports, peer reports and self-reports, respondents’ discipline has no significant effect on these. Participants indicated that their own practices and that of their peers falls short of the norms they endorse, but that their own behavior is much less ethically deficient than that of their peers. An exploratory factor analysis revealed that ethically questionable citation behaviors could be grouped usefully into three categories: strategic citations, neglectful citations, and blind citations. Contrary to our hypothesis, the survey showed that greater experience does not always result in better citation practices. A particularly divisive issue pertained to intentionally citing authors from underrepresented demographic groups for reasons of social justice, but broad support for this practice is lacking, although arts and humanities scholars are slightly more supportive. Most researchers view questionable citation practices as negatively affecting their disciplines. Our findings suggest the need for clearer articulations of the citation norms and improved guidance and training about citations. (shrink)

This innovative book investigates being Jewish not as a sectarian religiosity but as a way of being-in-the-world particularly suited to understanding Heidegger's early phenomenology. At its core is an intimate engagement with sacred texts,which grounds being Jewish in a way of life constituted as a way of reading-a way of reading transmitted to succeeding generations as a passionate teaching. A partnership of scholars, university professors, museum educators, and classroom teachers designed the project, which uses Rembrandt as the prism through which to diversify teaching of the core content areas of social studies and visual art. Members of this team attempted to expand the boundaries of themes traditionally found in art and other humanities disciplines by linking these with the social sciences, thereby forming what might be called “humanistic social studies.” The final product is a Web site to which teachers and those interested in using this type of instructional approach in their classroom teaching will have access. Funding for this project derived from a National Endowment for the Humanities (NEH) Curriculum Materials Development grant designed to promote the teaching of the humanities and support projects that can serve as national models.1In the eyes of many, Rembrandt is viewed primarily as a “European” artist. Although it is true that many of his major works are found in museums across Europe, he is generously represented in the holdings of collections across America. Yet for many teachers in the United States he remains an enigmatic figure; knowledge about his art is limited, and the U.S. museum collections of his work remain untapped for classroom application. To broaden the appeal and teaching potential of his work, the project team [End Page 1] mined this collection of “American” Rembrandts. Specifically, the project, targeted at secondary art and social studies teachers (grades 6 through 12), is committed to building and increasing the capacities of teachers to network knowledge of Rembrandt’s art with their classroom practice. Further, with its grounding in aesthetic education theory within a humanities framework, the project endeavors to promote instructional innovation and encourage teachers to break new ground in high-impact classroom pedagogy. The timing of the project and its ongoing development was not accidental. They converged with events held in 2006 to commemorate the four hundredth anniversary of Rembrandt’s birth. These events ranged from worldwide museum exhibitions to publications of books containing new insights on Rembrandt, all of this aimed at celebrating an artist whose achievements many consider to be a zenith of world culture.Why Rembrandt: The Rationale for the ProjectWhy is Rembrandt the artist at the center of this project? There are any number of good reasons, but the project’s rationale centers around three in particular. First, to borrow a term from Peter Kivy, Rembrandt is the ultimate “aesthetic symbol,”2 an indisputably blue-chip figure who produced some of the greatest masterworks of world art, many of which students find both intellectually engaging and psychologically insightful. Traditionally, teachers have striven to enrich the aesthetic lives of their students with exemplars of the human mind, and the genius of Rembrandt provides a potent opportunity to do so.3 By studying an artist of such stature teachers can develop students’ cultural intelligence and visual literacy and present opportunities to observe and decode substantive, challenging masterworks of art. In this context, Rudolf Arnheim describes a painting by Rembrandt as containing a network of “visual arrows” that communicate multiple experiences about the human condition, including love, tenderness, and desire, among others. Arnheim speaks of the additive nature of the experience, how the viewer—almost like a mathematician—needs to learn how to add up the clues and arrive at a solution. He does not intend, of course, for the viewer to have an impersonal, “clinical” experience. Rather, he writes, “art... is one of the most powerful instruments available to us for the fulfillment of life. But academic theatre's meteoric rise after the war years conceals more problematic qualitative achievements. Throughout its ascendancy, vexing questions persisted concerning the quality, standards, and evaluation of theatre programs. In academic journals and books, theorists explored with alacrity broad opportunities for educational theatre in the university. But they also bickered constantly about objectives and practices and their role in academe, ultimately providing a decidedly ambivalent assessment of accomplishment.According to Oscar G. Brockett, the fundamental questions are, What place, if any, should theatre have in a university? and, For what are students being educated?2 This study traces answers to these questions given by scholars and educators between 1945 and 1979.3 It explores the connections between the scholarship about theatre studies and the programs that developed, what scholars and educators wanted it to become, and what it became in the context of liberal arts education. These years are important because they are the golden age of higher education, a time of unprecedented expansion. Following World War II the G.I. Bill greatly increased student enrollment, and academic and research programs surged. At this time, the [End Page 57] university's governing interests were established by the politics of the Cold War, and the desire to surpass the Soviet Union at everything motivated the expansion of higher education.4 The National Defense Education Act of 1958 and the Higher Education Facilities Act of 1963 (legislation made possible by a prosperous economy) injected vast financial resources into program development, and federal programs such as the National Endowment for the Humanities (NEH) and the National Endowment for the Arts (NEA) were established.An earlier study of theatre curriculum between, roughly, the Civil War and the Second World War provides a useful background against which to interpret the data for this later period.5 From the earlier study we learn that academic theatre suffered from religious hostility for two centuries but that by the end of the nineteenth century there were extracurricular dramatic clubs and productions. The emergence of the modern research university brought with it the expansion and diversification of knowledge, the differentiation of the colonial college's general curriculum into discrete disciplines, and the departmentalization of the curriculum. As principles and aims for liberal arts education, and the bachelor of arts degree, began to take shape, reconstruction of the curriculum included the introduction of departments of speech and literature, which included dramatic curricula.6 Academic theatre first began in classical and later modern language departments as a way of teaching literature in another language; later speech and English departments added courses in oral interpretation and playwriting.After George Pierce Baker opened the theatre department at Yale in 1925, theatre became an autonomous field of study in increasing numbers of universities. Having surveyed the project from the perspectives mentioned, I then ask to what extent it was successful in avoiding the pitfalls that often frustrate the implementation of novel ideas and methods.1The HumanitiesThe following interpretation of the humanities is condensed from the writings of two distinguished philosophers, Albert William Levi and Walter Kaufmann, and the historian Paul Gagnon. Levi, an early member of the National Council for the Humanities and for most of his career a distinguished professor of the humanities at Washington University, was once asked to define the essence of the humanities. He replied that the purposes of the humanities are to encourage persons to “to think critically, to communicate successfully, and to walk proudly with [their] tradition.”2 Noteworthy in this terse statement is its emphasis on the procedural aspects of the humanities, that is, their effects on human actions and attitudes. Such emphasis accorded well with the tradition of the Middle Ages, which construed the humanities as skills of organizing and understanding human experience. Levi, however, also acknowledged the Renaissance conception of the humanities as subject matters, thereby paying tribute to the endeavors of Renaissance scholars who devoted themselves to recovering and transmitting the literary texts of antiquity. A strong believer in historical continuity, Levi synthesized the Medieval and Renaissance traditions by proposing that the humanities be understood as skills of communication, continuity, and criticism. These skills have their substantive grounding in languages and literatures, history, and philosophy, the latter conceived as critical reflection.3 After pondering Levi’s interpretation, I added another “c,” the arts of creation, to his troika. Thus, the humanities can be understood as indispensable to human experience because they are the arts of creation, communication, continuity, and criticism.Another view of the purposes of the humanities and their relevance to the project can be found in the writings of the historian Paul Gagnon. National Action Plans on business and human rights are a growing phenomenon. Since 2011, 42 such plans have been adopted or are in-development worldwide. By comparison, only 39 general human rights action plans were published between 1993 and 2021. In parallel, NAPs have attracted growing scholarly interest. While some studies highlight their potential to advance national compliance with international norms, others criticise NAPs as cosmetic devices that states use to deflect attention from persisting abuses and needed regulation. In (...) response to wider critiques of international human rights norms, and their failure to exact universal state compliance, experimentalist governance theory highlights the dynamic, dialogic and iterative character of human rights implementation as well as the role of stakeholders. In this article, we apply experimentalist governance theory to evaluate the role and character of business and human rights NAPs. Rather than attempting to evaluate NAPs’ ultimate consequences for rights-holders, which appears premature, we focus on NAPs processes. Specifically, we analyse NAPs processes in twenty-five states against five experimentalist governance criteria relating to stakeholder participation; agreement on a broad problem definition; local contextualisation; monitoring and peer review and periodic revision and learning. According to our findings, NAPs on business and human rights in most states demonstrate resemblance to the traits of experimentalist governance. In particular, our analysis points to the emergence of relatively sophisticated and demanding institutional governance mechanisms within NAPs — including the institutionalisation of complex deliberative processes. Nevertheless, our paper also identifies some significant shortcomings in NAPs, related to the lack of inclusion of vulnerable groups and the lack of explicit indicators and targets. (shrink)

With biobank research on the increase and the history of exploitation in Africa, it has become necessary to manage the transfer of human tissues across national boundaries. There are many accepted templates of Material Transfer Agreements that currently exist internationally. However, these templates do not address the specific concerns of South Africa and even of Africa as a continent. This article will examine three significantly important ethico-legal concepts that were deliberated and carefully adapted by a South African Institution to (...) suit the transfer of Human Biological Materials and associated data for biobank research, namely: informed consent; benefit sharing arrangements; and ownership together with intellectual property rights in human tissues. The discussion includes an analysis of current practice; the ethico-legal challenges in the South African/African context; the decisions made with regard to how the related ethico-legal challenges were addressed in the MTA; and justifications for implementing these decisions. The processes considered could be of benefit to other developing world countries who consider it necessary to manage the transfer of HBMs across national boundaries. (shrink)

The National Center for Biomedical Ontology is a consortium that comprises leading informaticians, biologists, clinicians, and ontologists, funded by the National Institutes of Health (NIH) Roadmap, to develop innovative technology and methods that allow scientists to record, manage, and disseminate biomedical information and knowledge in machine-processable form. The goals of the Center are (1) to help unify the divergent and isolated efforts in ontology development by promoting high quality open-source, standards-based tools to create, manage, and use ontologies, (2) (...) to create new software tools so that scientists can use ontologies to annotate and analyze biomedical data, (3) to provide a national resource for the ongoing evaluation, integration, and evolution of biomedical ontologies and associated tools and theories in the context of driving biomedical projects (DBPs), and (4) to disseminate the tools and resources of the Center and to identify, evaluate, and communicate best practices of ontology development to the biomedical community. Through the research activities within the Center, collaborations with the DBPs, and interactions with the biomedical community, our goal is to help scientists to work more effectively in the e-science paradigm, enhancing experiment design, experiment execution, data analysis, information synthesis, hypothesis generation and testing, and understand human disease. The latest volume in the splendid critical edition of the Opera philosophica et theologica of William of Ockham in progress at the Franciscan Institute of St. Bonaventure University under the general editorship of Gedeon Gál, O.F.M. The project itself is something of a phenomenon in the area of critical editions of medieval Latin texts in terms of the rapidity at which quality volumes are produced at remarkably reasonable costs. Since 1967 five quarto volumes, totaling some three thousand four hundred pages, (...) have appeared. Three of these contain the first portion of Ockham’s most important theological work, the Ordinatio of his "commentary" on book 1 of the Sentences. The final portion is scheduled to appear early in 1979 as volume 4 of the Opera theologica. Volume 1 of the philosophical opera contains the monumental Summa Logicae, and volume 3 will also appear this year, thus completing with the present volume the edition of the most important of Ockham’s logical works. Editors are also assigned and are already at work on the other major non-political writings, notably the Quodlibet and commentaries on Aristotle’s Physics. Since the Opera politica Guillelmi de Ockham were published in three octavo volumes by the University of Manchester Press, we may expect to have very shortly substantially all the works of the Venerable Inceptor, thanks to the exceptional industry of a team of highly qualified researchers as well as substantial grants by the National Endowment for the Humanities and the De Rance Corporation. Two of the editors of individual works in the present volume are deceased. Father Philotheus Boehner, O.F.M., who came to the Franciscan Institute from Germany before the outbreak of World War II, first conceived of and began work on the critical edition. His text of the Tractatus de praedestinatione was first published in 1945 in Franciscan Institute Publications, Text Series No. 2 and was subsequently translated into English by M. M. Adams and N. Kretzmann in 1969. It differs little in Brown’s revision, which adds variants from the Bruges MS, unavailable to Boehner because of the war. The other posthumous edition is that of E. A. Moody. This too appeared in the aforesaid Text Series as No. 14. The present text is identical with the earlier version, but observations and suggested alternate readings by the general editor are added in footnotes. The thirty-two pages of introduction contains a wealth of information. To mention but two items: One concerns the probable reason why Ockham only incepted in theology but never served as regent master. This apparently had little or nothing to do with Lutterall’s opposition, as Chancellor of the University, to Ockham’s views and his summons later to the papal court at Avignon. It stemmed rather from the Franciscan custom of promoting those bachelors who had completed their magisterial studies to regent master on the basis of seniority. At his time a junior like Ockham could expect a wait of eight to ten years. Although international research is increasing in volume and importance, there remains a dearth of knowledge on similarities and differences in “national human research ethics”, that is, national ethical guidelines, Institutional Review Boards, and research stakeholder’ ethical attitudes and behaviors. We begin to address this situation by reporting upon our experiences in conducting a multinational study into the mental health of children who had a parent/carer in prison. The study was conducted in 4 countries: Germany, Great Britain, Romania, and (...) Sweden. Data on NHREs were gathered via a questionnaire survey, two ethics-related seminars, and ongoing contact between members of the research consortium. There was correspondence but even more so divergence between countries in the availability of NEGs and IRBs and in researcher’ EABs. Differences in NHREs have implications particularly in terms of harmonization but also for ethical philosophy and practice and for research integrity. (shrink)

René Girard contends that—on the contrary—in the "leveled," horizontal world of a purportedly materialistic modernity this transcendent authority is deviated and distorted but it does not disappear. In his first major work, Deceit, Desire, and the Novel, (...) he argues that "the passion that drives men to seize or gain more possessions is not materialistic; it is the triumph of the mediator, the god with the human face."1 In a materialistic age, the gods are "pulled down from the heaven, the sacred flows over the earth" and men become "gods for each other."2Dana Gioia, former businessman and chairman of the National Endowment for the Arts, is no stranger to the economy of divinized desire. The stakes of our passions—whether we are wrecked by dubious wants or able to shed our infernal imitations—pierce his poetry. Gioia cites Girard as a significant influence alongside St. Augustine and Kierkegaard, though he does not indicate whether his own poetic investigations of mimesis are a direct yield of [End Page 149] his encounter with Girard or the independent discovery of attentive artistic intuition.3The refuge of lies so central to Girard is particularly palpable in Gioia's long narrative poem "Style."4 Charlie, the self-deprecating narrator, divinizes his college friend Tom, a business mogul who "prospered like one chosen by the gods."5 Tom uses his easy money to purchase gaudy metamorphoses, hosting magnificent events with his "flawless" wife Eden. An antihero of the unremarkable variety, Charlie attends all Tom's parties until he stops receiving invitations. When he discovers his deity's disappearance is tied to a terminal illness, he descends into the infernal "slums" of Tom's new hideout, and he finds his former hero hell-bent, ready to commit an arson that will erase his own existence in style. Charlie is confronted with a difficult decision that any coward would waver before. He has the chance to become an atheist—at least with respect to his dying god. After painting a portrait of man-made gods, the poem probes the question of whether and how we can cut short our penchant for great deceits.Charlie opens this narrative poem with an invective directed against himself.Just look at me. Isn't it obvious?I have no style. I'm just a human blur.On me expensive clothes look second-hand.They droop or sag. He employs the ascetical word "humiliation" in conjunction with a "haircut"—further revealing his unforgiving inner harshness. To avoid the commercialization of reproduction, the Canadian Assisted Human Reproduction Act (AHR Act 2004) prohibits the purchase of human eggs. We endorse this legal prohibition and moreover believe that this facet of the law should not be allowed to have as an unintended consequence an increase in transnational trade in human eggs. In an effort to avoid this consequence, and to be consistent with the AHR Act, we advocate the pursuit of national altruistic self-sufficiency. torts raise a number of interesting and perplexing philosophical issues. In a suit for ‘wrongful life’, the plaintiff (usually an infant) brings an action (usually against a physician) claiming that some negligent action has caused the plaintiff's life, say by not informing the parents of the likely prospect that their child would be born with severe defects. The most perplexing feature of this is that the plaintiff is claiming that he would have been better off if he had never been (...) born. A number of arguments have appeared which purport to show that ‘wrongful life’ claims should not be allowed, either because it is senseless to claim that one would be better off if one had not existed or that it is impossible to assess the extent to which someone has been damaged by being brought into existence. In our paper we rebut these arguments and suggest a procedure for determining damages in ‘wrongful life cases’. While CARA was one of several national events displaying nonmainstream art, it was also distinctive in its politics of self-representation. The artists participating in CARA insisted that they be described (...) as members of a Chicano art movement. With the term Chicano they hoped to step beyond labels preferred by the dominant culture—labels such as Mexican American, Latino, or Hispanic. For these artists, the word Chicano was appealing because it represented a complexity of meanings that they understood as being integral to both their identity and to the art they produced. The word Chicano, as Alicia Gaspar de Alba discusses in Chicano Art Inside/Outside the Master's House,1 embraces multiple meanings and axes of cultural identity; it derives from the Nahuatl pronunciation of Mexicano, often referring to a person of Aztec descent but including, as well, Native American heritage, Mexican roots, and Catholic faith. The CARA artists also embraced the label's association with a politics of liberation, popular protest, and working-class creativity. From the outset, then, the CARA exhibition was more than an art exhibition.By some lights, however, CARA was too much more than an art exhibition. When the organizers realized they needed funds, they applied for a National Endowment of the Humanities (NEH) grant and were initially turned down. While an NEH rejection might mean a number of things, the language of the rejection reports in this case narrows the possibilities down [End Page 65] to an issue that I mean to consider in this article. One rejection report states thatThe panelists understood that Chicano art arose from a variety of political movements and social causes, and therefore the political aspect of this proposal is appropriate to the subject matter.... Even so, the panelists worried that the project makes a political statement, that it is politics masquerading as culture, and that the proposal contains jargon and rhetoric and reads like a manifesto. 2Other reviewers objected to the general language of the report along similar lines. While Chicano artists made a point of representing themselves in complex, multidimensional terms, the NEH found such complexity and multidimensionality perplexing and thus their art not worthy of funding. One referee, for instance, claimed that the terminology used in the proposal was too narrow; he complained that defining Chicano in terms of struggle was too restrictive and excluded other Chicano artists for whom struggle was not a major concern. But later the same reporter objected that some of the concepts in the proposal were not inclusive enough, as they failed to include issues and topics that are central to the Chicano community. Thus the complexity and cluttered characterization that the artists felt was central to their sense of identity was dismissed as either too excessive or as too restrictive. According to the NEH, Chicano artists failed not because of their art (which the referees did describe as "visually compelling") but because of the way in which they chose to identify themselves—because, in other words, of their "rhetoric and jargon." Whatever it was that the NEH found compelling in the Chicano art they found uncompelling in the description of the Chicano artists' lives.After the organizers revised their proposal and reapplied for the grant, they were once again turned down. This second rejection highlights even more clearly the nature of the problem. This second report argues that "[T]here is a disjunction between the organizers' intentions and the exhibition. The changing situation in South Africa and Eastern Europe prompts Charles Villa-Vicencio to investigate the implications of transforming liberation theology into a theology of reconstruction and nation-building. Such a transformation, he argues, requires theology to become an unambiguously interdisciplinary study. This book explores the encounter between theology, on the one hand, and constitutional writing, law-making, human rights, economics, and the freedom of conscience on the other. Placing his discussion in the context of the South African struggle, the author compares this (...) situation to that in Eastern Europe, and the challenge of what is happening in these situations is identified for contexts where "the empire has not yet crumbled.". This paper argues that, in addition to humanitarian concerns, policies toward immigrants should also be shaped by recognition of special responsibilities toward some populations of noncitizens. National governments acquire such responsibilities in part through their histories of coercive impositions on those populations. Former imperial powers, in particular, often possess special obligations toward the inhabitants of their foreign colonies that go beyond their general humanitarian responsibilities. Those obligations might be met in various ways; but if national governments of wealthy, (...) formerly imperial states granted greater access for immigration to the poor of their former colonies, migration flows might significantly contribute to reductions in global levels of inequality. This article aims to discuss some theoretical problems regarding to human rights. It begins with a theoretician and conceptual discussion about modern State, empire of law, politics and law, sovereignty etc. and their relation with the idea of human rights, which have been more than ever supported and guaranteed by the Rule of law and its institutional arrangements. It has been necessary to briefly discuss the notion of citizenship to understand how human rights have arrived to such ordinance, for citizenship (...) would discharge, in XXth century, in the concept of human rights, whose redefinition would culminate in the Declaration of Vienna in 1993. After that, human rights had been studied through innumerable paradigms from different authors, whose statements and general lines are reconstituted and agglutinated in four typical-ideal models of interpretation. Finally, some statements regarding this subject had been made, from recent facts and events that have rearranged the worldwide politics in the beginning of the century, trying to confront the theories with the reality that is presented to us. This commentary considers the idea of collective responsibility in conjunction with the Russian invasion of Ukraine. Drawing on the works of Karl Jaspers and Hannah Arendt, I define a grounding for the political necessity of (self-)blaming the whole Russian nation for the crimes of this war. Researching in more detail the theological compounds of Jaspers’ views, I propose to consider the imposition of collective guilt on a nation as a form of archaic curse. I claim that the idea of metaphysical/ (...) class='Hi'>national responsibility essentially becomes a grip of death that manipulates the promise of renewal to reload hierarchical power cycles. The core of J.G. Herder's philosophy of nationalism lies in the conviction that human creativity must be embedded in the particular culture of a communal language. While he acknowledged that this cultural particular must be integrated into a more universal humanity, he insisted that each culture should preserve its incommensurable distinctiveness. He also called for a new method of enquiry regarding history, one that demands empathetic sensitivity toward the uniquely individual while realizing that there are few gains without losses. F.M. Barnard demonstrates that Herder, despite his innovative work on the idea of nationality, was fully aware of the dangers of ethnic fanaticism, but also of the hazards of what is now known as globalization, recognizing that these must be tempered by a sense of universal humanity. Barnard shows that Herder anticipated modern theories of the dynamics of cultures and traditions through the problematic interplay of persistence and change and that his speculations on cultural and political pluralism, on language as a democratic bond, and on the possible fusion of communitarian and liberal dimensions of public life remain relevant to contemporary debates. Issues of (...) both Science and Nature magazines celebrated the event by establishing interdisciplinary websites where readers can access essays on aspects of genome mapping and directly link to databases to search for more information on the topics (IV. Genome Gateway 2001; The Human Genome 2001). Since 1994, the National Information Resource on Ethics and Human Genetics (NIREHG), a special project of the National Reference Center for Bioethics Literature (NRC), has been providing such an integrated information service on ethics and genetics. Designed to enable a wide range of users to go from annotated bibliographies (Scope Notes) and brief essays (called "enotes") to database searching, NIREHG fosters an interdisciplinary approach to research on ethics and genetics.
